Broadcast giant ABS-CBN will comply with the National Telecommunications Commission's order for it cease operations after its legislative franchise expired on Monday.
"Millions of Filipinos will lose their source of news and entertainment when ABS-CBN is ordered to go off-air on TV and radio tonight (5 May 2020) when people need crucial and timely information as the nation deals with the COVID-19 pandemic," ABS-CBN said in a statement.

"This is in compliance with the cease and desist order issued by the National Telecommunications Commission (NTC) today that prohibits ABS-CBN from continuing its broadcast operations effective immediately," it added. -NB, GMA News

ABS-CBN ordered to cease operations due to expired franchise

The National Telecommunications Commission has ordered ABS-CBN to stop operating its various TV and radio stations nationwide following the expiration of its legislative franchise, the NTC announced on Tuesday afternoon.

In an order dated May 05, 2020, the NTC directed ABS-CBN to stop operating in various television and radio broadcasting stations nationwide, absent a valid congressional franchise which lapsed on May 4, 2020.

"Upon the expiration of RA 7966, ABS-CBN no longer has a valid and subsisting congressional franchise as required by Act No. 3846," it said in a statement.

The NTC, which earlier said it would grant a provisional authority (PA) to allow ABS-CBN to continue operations, has given the company 10 days from receipt of the order to respond.

The latest development came days after the Office of the Solicitor General warned NTC commissioners that they could face Anti-Graft and Corrupt Practices Act charges should they issue ABS-CBN Corp. and its affiliate ABS Convergence Inc. a provisional authority (PA) to operate after its franchise lapses on May 4, 2020.

The House of Representatives Committee on Legislative Franchises -- through a letter from House Speaker Alan Peter Cayetano and panel chair Franz Alvarez dated February 26, 2020 -- formally requested the NTC to grant ABS-CBN a PA to be able to operate beyond May 4.

NTC has sole authority -Palace

Presidential spokesman Harry Roque on Monday said the continued operation of broadcasting company ABS-CBN would solely depend on the decision of the NTC.

Roque made the comment amid the statement of Solicitor General Jose Calida threatening NTC over the weekend that its officials will face graft charges if it will allow ABS-CBN to operate on an expired franchise.

ABS-CBN’s franchise expired on Monday, May 4.

“Ang Solicitor General ay alter ego ng ating Presidente, at sumulat nga siya sa NTC. (The Solicitor General is the alter ego of our President, and he wrote to the NTC) This must be dealt with by the NTC as a quasi-judicial body,” Roque said.

“Aantayin po natin ang sagot ng NTC. Ang desisyon po ng NTC ang ipapatupad ng Presidente. Hindi puwedeng impluwensiyahan ng Presidente ang NTC,” Roque added. -NB, GMA News

Former Vice President Jejomar Binay gave his reaction to the closure of the ABS-CBN network.
KAMI learned that the statement of Binay comprised mainly of two ideas. One, he mentioned about who gets to bear the responsibility of the network's shutdown. Two, he mentioned about democracy dying.

He also described the closure as a "creeping erosion of civil liberties."


News 5 reported that Binay said:
"We may argue on who bears greater responsibiilty for the cosure of ABS-CBN. But we cannot deny that the day the network went off the air 48 years ago was also the day democracy died."

In ABS-CBN's report, Binay encouraged the employees of the network by saying:
"We hope that the men and women of ABS-CBN will continue to pursue the great calling of journalism in the service of the Filipino, especially in this period of uncertainty and anxiety over the COVID-19 pandemic and the creeping erosion of civil liberties, of which the network’s closure is an eloquent example."

Senator Nancy Binay also released a statement on the matter, even before former VP Binay did. She said that it was prejudicial to the 11,000 workers who lost their jobs.

Shutdown of ABS-CBN operations not a repetition of history -Panelo

Chief Presidential Legal Counsel Salvador Panelo on Wednesday rejected comparisons between the closure of ABS-CBN’s operations because of an expired franchise and the shutdown of the broadcast network in 1972 due to martial law.

“I don’t think there’s a repetition of history. When martial law was declared, the then president had the power to close all communications and telecommunications [companies],” he said in an interview on ANC.

“This particular chapter of our history, the President (Rodrigo Duterte) does not have that power. Congress has that power. There is a wheel of a difference between then and now.”

ABS-CBN went off the air on Tuesday night in compliance with the cease and desist order by the National Telecommunications Commission, which ruled that the company could not operate on an expired franchise.

The media giant was also padlocked in 1972 when then-President Ferdinand Marcos placed the Philippines under martial law in response to communist insurgency.

Panelo said the current situation of ABS-CBN was not the fault of the President, who had repeatedly threatened not to renew its franchise over unaired political advertisements in 2016. Duterte has since accepted ABS-CBN's apology and left the fate of its franchise to Congress.

“You cannot put the blame on him. ABS-CBN knew from the very start that its franchise would be expiring, then it should have done its part in asking Congress to do its job. Did it do it?” he asked.
